Please read these Terms carefully before using ExamPrep. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
1. Acceptance of Terms
By accessing or using ExamPrep (the "Service"), you agree to be legally bound by these Terms of Service. If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Service. Your continued access constitutes full acceptance of these Terms as they may be updated from time to time.
2. Nature of the Service
ExamPrep is an independent educational practice tool created for personal study purposes. It is not an official examination provider, not affiliated with any academic institution or certification authority, and does not issue credentials of any kind.
3. Account Activation and Access
To gain access to the platform, you must register an account and purchase access using our virtual currency system. We reserve the right to grant, deny, suspend, or revoke access to the platform at our sole discretion.
4. No Guarantee of Academic or Professional Outcomes
We make no representations or guarantees regarding examination performance, certification results, academic success, employment prospects, or professional advancement. Any outcomes resulting from your studies depend entirely on your own effort, preparation, and external evaluation standards beyond our control.
5. Virtual Currency, Purchases, and Subscriptions
The Service utilizes a virtual wallet system powered by "Stars" (★). Users can top up their wallet to purchase access to study materials. Star prices and the stars required to unlock exams, subscription passes, grammar lessons, or RSVP packages are displayed dynamically on the platform and may be adjusted from time to time. Stars (★) are a non-refundable virtual currency designed solely for use within ExamPrep and hold no real-world monetary value.
6. Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and monitoring your wallet balance. We are not responsible for any loss, damage, or unauthorized activity (including unauthorized use of Stars) resulting from your failure to safeguard your account information.
7. Server Data Storage
Your study answers, progress records, purchase history, and wallet balances are stored on server infrastructure associated with your account. While we maintain such data to support your use of the Service, we do not guarantee permanent storage, backup availability, or recovery. Loss of data may occur and remains your responsibility.
8. Service Availability
We do not guarantee uninterrupted availability of the Service. The platform may be modified, suspended, restricted, or permanently discontinued at any time without prior notice. We bear no liability for downtime, interruptions, or permanent removal of features.
9. No Warranties
To the fullest extent permitted by applicable law, the Service is provided strictly "as is" and "as available." We disclaim all warranties, whether express or implied, including but not limited to accuracy, reliability, availability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by applicable law, the operator of ExamPrep shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Service. This includes, without limitation, loss of study data, examination results, missed opportunities, device damage, system failure, or security incidents. You agree that you use the Service entirely at your own risk.
11. Indemnification
You agree to indemnify and hold harmless the operator of ExamPrep from any claims, liabilities, damages, losses, or expenses arising from your misuse of the Service, violation of these Terms, or infringement of any third-party rights.
12. Prohibited Conduct
You may not misuse, disrupt, interfere with, reverse-engineer, exploit, or attempt unauthorized access to the Service, its billing system, or its infrastructure. Any such actions may result in immediate termination of access, forfeiture of remaining Stars, and possible legal action where applicable.
13. Intellectual Property
All platform content, including code, design, structure, and branding, remains the intellectual property of the operator. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for personal educational purposes. Commercial use is strictly prohibited.
14. Right to Modify or Terminate
We reserve the right to modify pricing, suspend, restrict, or terminate the Service, or any user access to it, at our sole discretion and without prior notice.
15. Amendments to Terms
We may update these Terms periodically. Continued use of the Service after changes are published constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Kingdom of Thailand.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and the operator regarding the Service and supersede any prior understandings or representations.
19. Assumption of Risk
By using this Service, you expressly acknowledge and agree that you assume all risks associated with its use, including technical failures, data loss, inaccurate content, and any educational outcomes.
20. Disclaimer
The Service is provided for general educational purposes only. While we strive to provide useful and accurate content, we make no guarantees regarding completeness, reliability, or suitability for any specific purpose. You acknowledge that any reliance on the Service is at your own risk.
21. Acceptable Use Policy
You agree to use the Service only for lawful and appropriate purposes. You must not: - Use automated systems (bots, scripts, scraping tools) without permission - Attempt unauthorized access to any part of the Service - Interfere with servers, networks, or system integrity - Abuse system resources or perform excessive requests - Distribute harmful content, malware, or spam - Impersonate other users or entities We reserve the right to monitor, investigate, and take action against violations, including suspension or permanent termination of accounts and forfeiture of wallet balances without prior notice.
22. Gamification, Streaks, and Streak Recoveries
The Service provides gamification features including XP points, Levels, Daily Missions, and Daily Streaks to encourage study consistency. Daily Streaks represent consecutive days of platform activity. If you fail to log activity within a calendar day, your streak will be broken. Free monthly recovery attempts are allotted according to streak length tiers configured by the administrator. Once free monthly recovery attempts are exhausted, users may purchase additional recovery attempts at the cost of one (1) Star per recovery. Star purchases for streak recovery are non-refundable and hold no monetary value.
23. RSVP Speed Reading, Grammar Lessons, and Cloze Practice
Our specialized features—RSVP Speed Reading, Grammar Lessons, and Cloze Practice—are provided to enhance English language comprehension and vocabulary. RSVP Speed Reading delivers content at customizable speeds ranging from 150 to 700 WPM. Grammar Lessons provide structured chapters with inline checkups. Cloze Practice provides vocabulary decks using fill-in-the-blank questions. These tools are educational aids; we do not guarantee certification achievements or specific language score outcomes through their use.
